Informed Actions
Lenders like to request a solicitor’s certificate as part of the loan process because it confirms that the borrower or guarantor has received independent legal advice and understands the implications of the loan transaction or guarantee and have made an informed decision to enter into legally binding contracts.
Mutual Understanding
As part of the process of issuing a solicitor’s certificate I discuss with the borrower or the guarantor:

The general nature and effects of the terms and conditions of the documents to be signed.

their liabilities, obligations and the potential risks under the terms of the reverse mortgage or guarantee that they are signing.

their rights and the obligations of the lender under the loan documents.
Unbiased Support
I act independently of the broker who is arranging your lending and the lender itself. Therefore, I provide unbiased legal advice.
Once the documents have been signed and the certificate provided, I update the broker or lender that the documents have been signed and are being returned. I also ensure any special settlement conditions such as rates notices, bank account information for the deposit of funds and updated certificates of insurance that are required prior to settlement have been provided with the signed documents. This assists in eliminating delays for settlement.
Professional Fees
My professional fee for the provision of a solicitor’s certificate starts at $350 inclusive of GST for one person or $440 including GST for 2 people.
